Description of contract.
Provision of a comprehensive integrated system/(s) to support delivery of mental health and learning disability services within a High Secure Forensic Mental Health Hospital.
The solution will be capable of replacing all current patient management, clinical noting, statutory reporting and mental health act administration functionality. The solution may include application software and/or utility system software.
The solution must include flexible interface capabilities and facilities to allow local tailoring and development of the solution.
Functional requirements.
The solution required should be fully integrated and must encompass the following mental health and learning disability functionality:
Patient administration and management, including Patient master index.
(PMI) covering all referrals, inpatients, admissions, discharges, transfers, waiting lists, bed management, appointment scheduling, clinical coding and grouping, clinical links, production of letters.
Clinical workflow, care planning, care management assessment, individual personal budgets.
Care programme approach and mental health act administration.
Clinical documentation (including clinical noting, clinical documentation and clinical correspondence), document management.
Scheduling including departmental, enterprise-wide, multi-resource and Protocol-based scheduling.
Flexible report creation facilities.

CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU FUNDS
The State Hospital is Scotland's only high security hospital. It provides assessment, treatment and care in conditions of special security for individuals with mental disorder who, because of their dangerous, violent or criminal propensities, cannot be cared for in any other setting. Employing around 700 staff, the hospital is a national resource for Scotland and Northern Ireland.
The State Hospital is one of four high security hospitals in the UK, and one part of the pathway of care that should be available for those with secure care needs. The other three specials hospitals are in England – Broadmoor, Rampton and Ashworth. The State Hospital is part of the NHS in Scotland, therefore functions within a different legal framework from these hospitals. Additionally, for comparative purposes, the amount of money spent on patient care in the State Hospital is significantly less (up to one-third less) than our English counterparts. Patients are admitted to the hospital under the provisions of The Criminal Procedures (Scotland) Act 1995, The Mental Health (Care and Treatment) (Scotland) Act 2003, and other related legislation.
Given that the patients do not have access to other services or communities, the hospital must address all of their needs (eg. therapeutic, vocational, social and physical wellbeing) via a range of facilities within a highly secure perimeter.
Modernising mental health services is one of the government's key priorities. The current facilities at the State Hospital are no longer suitable. Significant rebuild needs to take place due to the poor physical condition of the estate and obligations to meet statutory requirements to ensure patients are treated in accommodation appropriate to their needs and in an environment that supports rehabilitation. This forms part of national mental health policy to provide services that are appropriate and local where possible.
A number of investment options were explored and in 2005 the Scottish Government accepted that a publicly-funded procurement would deliver better value for money than a privately financed alternative. In January 2006, the State Hospital adopted the 'develop and construct' variant of 'design and build' as its construction strategy along with a three-stage 'negotiated procedure' procurement strategies.
The current site located in Lanarkshire is easily accessible to Edinburgh, Lothian, Glasgow, Stirlingshire, and the South of Scotland.
Early 2008, the State Hospital and multi-national building contractor, Skanska, entered into a 65m GMP contract to rebuild the hospital. The objective being to replace the existing hospital with a modern 'state-of-the-art' hospital, which should be completed by 2010/11. Under the contract, Skanska will build 19 000 m2 of new wards and facilities, as well as refurbishing a further 1 500 m2. The operation of the hospital will continue as normal during the construction.
The most significant risks that could impact on the capital value of the scheme (or on the delivery of the capital programme) have been identified along with appropriate mitigation strategies, and there are robust project management arrangements covering cost management, cost control, claims management change control and contingency management value management. This will ensure effective monitoring and control of the development and implementation of the scheme.
Additionally, the State Hospital has been committed to continuous risk management throughout the life of the project. All risks have been identified, analysed, mitigated and controlled. A development control plan has been developed that will allow the hospital to remain both fully secure and fully operational during the construction of major new facilities on its existing site. The construction and refurbishment work will take place in four phases: enabling; construction of essential services and the activity centre; construction of the ward hub and clusters; and final works and landscaping.
The project's objectives (making best use of resources whilst providing patients with accommodation that supports their recovery and is appropriate to their needs) have been a constant reference point throughout the development of the scheme's design.
During the early design stages, the hospital took advantage of design advice offered by the Carbon Trust in order to address sustainability issues within the design. Around 15 % of the building materials will be recycled products. The hospital's infrastructure will be renewed as part of the project, eg, new water mains and IT network. The hospital's commitment to meet environmental targets is demonstrated by the selection of a woodchip biomass boiler system to heat the hospital.
The contractor's master programme, which incorporates variants agreed by the State Hospital, confirms that the timetable can be met with the Phase 1 buildings being commissioned and transferred by April 2009 and the second phase reaching the same point by November 2010.
The State Hospital has assessed the benefits arising from the project and prepared a benefits realisation plan. A post project evaluation will be undertaken within six months of the commissioning of the second construction phase to determine the degree to which the investment objectives have been met and to consider the acceptability to the end-user of the new facilities provided. The hospital believes that valuable lessons can be learned from its experience and these will be shared with the wider NHS community.
Reconfiguration of the site will enable the hospital to maximise its desired service model based on multi-disciplinary clinical teams organised around patient care and need. The new site will be more reflective of 'normal living' and will remove the feel of an institution. The right treatments will be delivered, by the right people, at the right time and in the right place.

Body responsible for appeal procedures
Precise information on deadline(s) for lodging appeals: The authority will incorporate a standstill period of a minimum of 10 calendar days at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from notification of the award decision to request additional debriefing and that information will be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the address in section 1.1. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts (Scotland) Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in a court of competent jurisdiction. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the settling aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
