    Working with the College to undertake due diligence on a new site in Grays Town Centre. The successful Private Sector Partner (PSP) would then work with the College to develop designs, obtain statutory consents and construct circa 15 000 m² (GIA) of new educational facilities. In addition the PSP will be required to buy the College's existing Woodview site which will be surplus to requirements following construction of new facilities. The PSP will work with the College to design andobtain statutory consents for residential development. The PSP may be required to provide loan and transitional finance to structure the deal.

    Economic and financial capacity

    Information and formalities necessary for evaluating if requirements are met: (1) All candidates will be required to provide a reference from their bank;

    (2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance;

    (3) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice;

    (4) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.

    Minimum level(s) of standards possibly required The economic operator must have sufficient economic and financial capacity to secure the delivery of the proposed works i.e the total project cost should not be greater than circa one fifth of the economic operator's turnover over each of the last 3 years (or where the economic operator is a joint venture vehicle, the parties comprising the vehicle or at least one of the parties guaranteeing the performance of the vehicle must individually have a turnover of at least five times the total project cost). For the purposes of this minimum level, the total project cost for the delivery of the College facility should be assumed at GBP 41 000 000. This is a pass/fail criterion.

    Information and formalities necessary for evaluating if requirements are met:

    (1) A statement of the candidate's average annual number of staff and managerial staff over the previous 3 years;

    (2) Details of the educational and professional qualifications of their managerial staff; and those of the person(s) who would be responsible for providing the services or carrying out the work or works under the contract;

    (3) A check may be carried out by the contracting authority or by a competent official body of the State in which the candidate is established, to verify the technical capacity of the candidate; and if relevant, on the candidates study and research facilities and quality control measures;

    (4) An indication of the proportion of the contract which the services provider intends possibly to subcontract;

    (5) A list of works carried out over the past 5 years, detailing the value of the consideration received; when and where the work or works were carried out; and whether they were carried out according to the rules of the trade or profession and properly completed.

    Lodging of appeals

    Precise information on deadline(s) for lodging appeals: The College will observe a minimum of 10 calendar days standstill from the point at which its decision on award of the contract is communicated to unsuccessful tenderers. This period allows unsuccessful tenderers to seek further debriefing from the College before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional information which must then be provided no later than 3 working days before the end of the stand still period. Any request for such additional information should be addressed to the contract idenitifed at section 1.1. Aggrieved parties who are not satisfied after provision of information in accordance with the preceding paragraph and who have been harmed or are at risk of harm by a breach of the Public Procurement Regulations 2006 (SI 2006 No 5) may take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly within 3 months of the alleged breach.
