Combat Tracks Group Systems Team, part of the UK Ministry of Defence, intends to award a Contract to Kidde Graviner Limited for the supply of a quantity of FM200 fixed fire extinguishers on all CRARRV platforms to replace existing extinguishers which contain Halon 1301 gases. This is in response to a Health and Safety requirement as a result of the Montreal Protocol phasing out Halon 1301 gases in fire-suppressant systems which the government of Canada has implemented with immediate effect. Much of the UK’s training using the CRARRV takes place in Canada. Placing this contract will allow training of service personnel on the CRARRV platform to continue and maintain a unified fire-suppressant system on all vehicles. It is considered that this award of Contract can be placed using the negotiated procedure without prior publication pursuant to Articles 31(1)(b) and 31(1)(c) of Directive 2004/18/EC, Regulations 14(1)(a)(iii) and (iv) of the Public Contracts Regulations 2006. This is because there is no manufacturer of fire extinguishers to this design, other than Kidde Graviner who hold the IPR, who could meet the required specification. So for technical reasons, the public contract may only be awarded to this company. Given the legislative position in Canada, which is outside of the UK MOD’s control, replacing the extinguishers is extremely urgent and the time limits for the open, restricted and negotiated procedures cannot be complied with.
