    Scottish Water wishes to procure provision of a site and/or development and construction of the site in the Greater Glasgow and surrounding area to provide construction of a state of the art operational centre and office accommodation with the provision of ancillary services, as replacement for the majority of existing facilities at Balmore Road. The scope will include options for the (a) fit out and furnishing of the buildings, (b) provision of life cycle maintenance and other facilities service contracts for the new office and (c) purchase of the existing facilities at Balmore Road.

    A market information day will be held at Scottish Water’s offices at 419 Balmore Road, Glasgow, G22 6NU, UNITED KINGDOM on 2.8.2010 commencing at 10:30 AM.

    Scottish Water is seeking the acquisition and/or physical development of a site in the Greater Glasgow and surrounding area. The development partner in relation to lot 2 or lot 3 should be prepared to work together with Scottish Water and its professional advisers to develop a state of the art secure building capable of providing approximately 7 000 to 10 000 sqm of space. It is envisaged that the development partner will play a major role in the construction element of the project.

    Acquisition of a site to facilitate the development of a building capable of providing approximately 7 000 to 10 000 sqm. Site must meet the following characteristics:

    — Within the greater Glasgow and surrounding area,

    — Within convenient commuting distance for public transport and motorway network and convenient reach of shopping and leisure amentities,

    — Sufficient land to develop on-site car parking up to maximum permitted by local authority planning guidelines,

    — Valid and marketable title,

    — Free of environmental contamination as demonstrated by appropriate site investigation reports,

    — Planning Consent for Class 4 use,

    — Approximately 5 acres.

    Subject to testing of option, may include the sale of Balmore Road.

    Scottish Water anticipates only taking forward to detailed negotiations (a) lots 1 and 2 separately or (b) lot 3. This decision will be taken as early as possible in the process. Further information will be made available in the prequalification questionnaire and tender documents.

    Note that lot 1 is a voluntary OJEU advert as the acquisition of land is excluded by the operation of Article 24(a) of Directive 2004/17/EC. Consequently, the procedures laid down in the Directive and the Remedies Directive do not apply to this lot.

    Respondents to this notice should be able to exhibit a valid marketable title to the site when responding to the Pre Qualification Questionnaire.

    — Appropriate provision of meeting rooms, break-out areas, canteen and staff facilities,

    Precise information on deadline(s) for lodging appeals: In accordance with regulation 33 of The Utilities Contracts (Scotland) Regulations 2006 as amended (the Regulations) Scottish Water will incorporate a minimum of 10 calendar day standstill period between the communication of the award decision and the decision to enter into the contract with the successful tenderer. A breach of any duty owed under the Regulations is actionable by any economic operator which, in consequence of the breach, suffers, or risks suffering, loss or damage and such proceedings may be brought either the Sheriff Court or Court of Session. Any such action must be brought within 3 months from the date when grounds for the bringing of proceedings first arose unless the Court considers that there is good reason for extending the period within which proceedings may be brought.
