As part of the Government’s Centralised Procurement agenda, Buying Solutions, working with strategic partners within the public sector, is seeking to establish a pan government framework agreement for the supply of motor vehicles (including alternative fuel and electric vehicles) for use by UK public sector bodies including but not limited to those set out in VI.3 and the use of this framework agreement for the supply of motor vehicles to Central Government Departments, Executive Agencies and Non Departmental Public Bodies will be mandatory.
The aim of the framework is to appoint suppliers who will be responsible for the complete supply chain from vehicle manufacturer through to after sales support.
The framework will be divided into the following lots:
Lot 1 – Cars including 4X4s;
Lot 2 - Light to medium commercial vehicles up to, but not including, 7.5 tonnes (inc car derived vans and mini buses);
Lot 3 – Medium and Heavy commercial vehicles 7.5 tonnes and above;
Lot 4 – Motorcycles;
Lot 5 – Buses and coaches.
Buying Solutions reserves the right for an electronic auction to be held by any Public Sector body listed below during further competition among the parties to the framework agreement(s).
Buying Solutions requires an option to extend the duration from 36 months for up to a further 12 months.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
Participants will be advised if this is necessary during the procurement. Parent company and/or other guarantees of performance and financial liability may be required by Buying Solutions if considered appropriate.

No special legal form is required but if a contract is awarded to a consortium, the contracting authority may require that any contract awarded be entered into by a single legal entity on the part of the successful candidate.
III.1.4)
Other particular conditions to which the performance of the contract is subject
Information and formalities necessary for evaluating if requirements are met: Any supplier shall be treated as ineligible and shall not be selected if that supplier or its directors or any other person who has powers of representation, decision or control of the supplier has been convicted of any of the following offences:
(a) conspiracy within the meaning of Section 1 of the Criminal law Act 1977(a) where that conspiracy related to participation in a criminal organisation as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(b) corruption within the meaning of section 1 of the Public Bodies Corrupt Practices Act 1889 or section 1 of the Prevention of Corruption Act 1906;
(c) the offence of bribery;
(d) fraud, where the offence relates to fraud affecting the financial interests of the European Communities as defined by Article 1 of the Convention relating to the protection of the financial interests of the European Union, within the meaning of:
(i) the offence of cheating the Revenue;
(ii) the offence of conspiracy to defraud;
(iii) fraud or theft within the meaning of the Theft Act 1968 and the Theft Act 1978;
(iv) fraudulent trading within the meaning of section 458 of the Companies Act 1985;
(v) defrauding the Customs within the meaning of the Customs and Excise Management Act 1979 and the Value Added Tax Act 1993;
(vi) an offence in connection with taxation in the European Community within the meaning of section 71 of the Criminal Justice Act 1993 or
(vii) destroying, defacing or concealing of documents or procuring the extension of a valuable security within the meaning of section 20 of the Theft Act 1968;
(e) money laundering within the meaning of the Money Laundering Regulations 2003; or
(f) any other offence within the meaning of Article 45(1) of the Public Sector Directive as defined by the national law of any relevant State.
A Supplier may be treated as ineligible or may not be selected if that Supplier:
(a) is bankrupt or is being wound up, or has had a receiving order or administration order or bankruptcy restrictions order made against him, or his affairs are being administered by the court, or he has entered into an arrangement with creditors or he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) being a partnership constituted under Scots law has granted a trust deed or become otherwise apparently insolvent, or is the subject of a petition presented for sequestration of its estate;
(d) being a company or any other entity within the meaning of section 255 of the Enterprise Act 2002 has passed a resolution or is the subject of an order by the court for the Company’s winding up otherwise than of the purpose of bona fide reconstruction or amalgamation, or has had a receiver, manager or administrator on behalf of a creditor appointed in respect of the company’s business or any part thereof or is the subject of the above procedures or is the subject of similar procedures under the law of any other state;
(e) has been convicted of a criminal offence relating to the conduct of his business or profession;
(f) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(g) has committed an act of grave misconduct in the course of his business or profession;
(h) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(i) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;
(j) is guilty of serious misrepresentation in supplying the information required under this section.

The duration referenced in Section II.1.4 is for the placing of orders under the framework.
The value provided in Section II.1.4 is only an estimate. Buying Solutions cannot guarantee to suppliers any business through this framework agreement. Spend and volumes may vary throughout the life of the framework agreement from the anticipated levels given in this notice.
Potential suppliers should note that Buying Solutions reserves the right to cancel this procurement at any stage and not to award any contract as a result of the procurement process commenced by publication of this notice.
If Buying Solutions decides to enter into a framework agreement with successful suppliers, this does not mean that there is any guarantee of subsequent contracts being awarded. Any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of potential suppliers and in no circumstances will Buying Solutions be liable for any costs incurred by candidates associated with the compilation and submission of tenders.
Any orders placed under any framework agreement entered into as a result of this procurement process will form a separate contract under the scope of this framework between the supplier and the requesting contracting body.
Buying Solutions and other contracting bodies using the framework, reserve the right to use an electronic portal during the life of the agreement.

Precise information on deadline(s) for lodging appeals: The Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. Applicants who are unsuccessful shall be informed by the Authority as soon as possible after the decision has been made as to the reasons why the Applicant was unsuccessful. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Authority to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
