    Hay Lane and Grove Park are two all age special schools located on adjacent sites off Stag Lane in Kingsbury. The schools cater for a wide range of special educational needs including profound and multiple learning difficulties, severe learning difficulties, autism with associated learning and behavioural difficulties and physical disabilities. The range and complexity of needs of children attending the two schools are increasing and there is an increasing overlap in the type of needs that the two schools serve.

    Following the required statutory consultation proposals were agreed to bring the two, hitherto separate, schools together as one school with effect from 1.9.2010. From that date Grove Park School will close with effect from 31.8.2010 and Hay Lane School contemporaneously expanded to 210 to take the current roll of both schools. The new school will be renamed 'The Village School'.

    The London Borough of Brent now seeks to procure a Design and Build Partner, to finalise the novated design and construct the new school.

    All dates and time periods specified in this notice are only provisional and the contracting authority reserves the right to change these. If any prospective bidder considers that any information supplied by them is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity as well as the duration of such sensitivity specified. In such cases the relevant material will, in response to request made under the Freedom of Information (FOI) Act 2000, be examined in the light of exemptions in that Act prospective bidders who wish to express an interest in this contract must request a pre-qualification questionnaire PQQ) from the contact in section 1.1. The PQQ will contain further details on the required conditions for participation referred to in Section III.2 above. Prospective bidders must note that their completed PQQ’s must be returned to the address stated in.

    The PQQ by no later than midday on Tuesday August 31 the contract shall be made in England and according to English Law and subject to the exclusive jurisdiction of the English Courts the contracting authority reserves the right not to make any award and reserves the right to accept all or part of any tender unless the prospective bidder expressly stipulates otherwise in the tender.

    Lodging of appeals

    Precise information on deadline(s) for lodging appeals: The Council will incorporate a 10 day calendar standstill period at the point information of award is communicated to tenders. This period allows unsuccessful tenders to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such information should be requested from the Council contact point as shown at I.1 if an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireleand). Any such action must be brought promptly. Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any documents and may award damages. If the contract has already been entered into the court may only award damages.
