Information on framework agreement
The Science and Technology Facilities Council's Central Laser Facility, at Rutherford Appleton Laboratory, Harwell, is to be increased in size to accommodate a new, enhanced laser research installation. This project comprises the construction of a multi-storey extension to the existing R1 building, and the reconfiguration of certain areas within the existing building, to suit the new laser equipment. The works are to be undertaken during vacant possession of the existing building although activities in and around adjacent buildings will be ongoing throughout the works. The extended building will use existing site wide services infrastructure, although certain existing services will need to be diverted as part of the works to facilitate the extension of the building. Additionally the client may wish to engage with the successful bidder in value engineering the project to achieve a successful outcome.

Precise information on deadline(s) for lodging appeals: The Contracting Authority will notify suppliers knocked out at PQQ stage and not invited to tender why they were unsuccessful.
The Contracting Authority will incorporate a minimum 10 calendar day stand still period at the point information on the Award of the Contract is communicated to tenderers. The 10 day period will be extended to 15 days from the 'relevant sending date' when the 'Alcatel' letter is not sent electronically.
This period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into. Such additional information should be requested from the address in Section I.1.
The Public Contracts (Amendment) Regulations 2009 also clarify that a letter received from an unsuccessful bidder is not in itself enough to extend the legal standstill period and prevent the authority signing the contract. To do so, a bidder must actually go to court, issue proceedings, and serve them.
If an appeal regarding the award of the contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No 5) as amended by The Public Contracts (Amendment) Regulations 2009, provide for aggrieved parties who have been harmed or are at a risk of harm by breach of the rules to take action in the High Court (England Wales and Northern Ireland).
The new limitation period will apply specifically where a bidder brings an 'ineffectiveness' claim. There is a six month long stop period that will be shortened to 30 days where the authority has published an award notice, or where they have notified the losing bidders of their exclusion, and given proper reasons.
