BCT and JNCC are entering into a Memorandum of Agreement to continue their partnership which aims to maintain the continued development of bat monitoring in the UK via the National Bat Monitoring Programme. The Partnership is expected to deliver trends to assess the status of UK bats, but also to facilitate a greater understanding of what is happening to bats in the wider countryside and of the factors affecting those species. It will therefore contribute to the UK's surveillance obligations under Article 11 of the Habitats Directive and to the next UK Report on Implementation of the Habitats Directive in 2013. The Partnership also aims to undertake capacity building activities to develop the network of NBMP volunteers.

Legal advice was sought from our Solicitors and based on the knowledge and activities contained within the work schedule concluded that the supply is exempt from public tender as the service provided is based on the Research and Development exemption pursuant to regulation 6(2)(k) of the Public Contract Regulations 2006. "6(2) These regulations do not apply to the seeking of offers in relation to a proposed public, framework agreement or dynamic system: - ...(K) for research and development services unless: - (i) the benefits are to accrue exclusively to the contracting authority for its use in the conduct of its own affairs; and (ii) the services are wholly paid for the contracting authority" In the current relationship with BCT that the benefits accrue to both JNCC and BCT (as well as JNCC partners) and the research is funded jointly by JNCC and BCT as well as reliance on an unpaid workforce
