    The Environment Agency National Trading and Regulatory Services have been tasked with providing an IT system to support the new EU Emissions Trading System (ETS) Duties for Aviation.

    This new proposed system is known as The EU ETS Workflow Automation Project (ETSWAP).

    The EU ETS requirements have been divided into modules as follows:

    Module 1 ETSWAP Aviation full functionality (target date for implementation by Oct 2010).

    Module 2 ETSWAP for Installations (target date for implementation by March 2011).

    Module 3 Configurable data collection system to support Introduction of EU ETS Phase 3 (Marine, Nox, N20 and Carbon Capture) (target date for implementation by June 2011).

    Module 4 EU ETS Phase 3 Full Requirements (target date for implementation by June 2012) and connection to EU ETS Community Registry target date to be agreed.

    We aim to let a framework agreement which will cover delivery of all 4 modules, including fixed price quotations for delivery of Modules 1 and 2. Upon successful completion of the procurement process, we will commit to development of Module 1 as a managed service and will call off future modules and enhancements as work packages as the legislation demands.

    This project expects to be able to reuse many of the components developed for Module 1 for subsequent modules, and to provide a scaleable platform capable of handling the development of the prospective requirements of all 4 modules.

    The framework will contain clauses allowing the contracting authority to novate the support of the service to its outsourced IT service provider.

    The Environment Agency expects to agree the IPR ownership of the ETSWAP solution following selection of the preferred supplier and it is anticipated that the solutions developed under this framework could be used by other European Member States.

    The scope of this framework is intended to meet the needs of the Environment Agency, the Scottish Environmental Protection Agency, the Northern Ireland Environment Agency and the Irish Environmental Protection Agency.

    Precise information on deadline(s) for lodging appeals: The Environment Agency will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have two working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the address in section 1.1.

    If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the settling aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
