    One North East is committed to actively deliver the governmnets policy for an electric vehicle infrastructure to the North East Region. This requirement is funded from the Office for Low Emission Vehicles Plugged in Places Programme.

    The contracting authority is seeking to appoint a minimum of three suppliers to the framework to supply the contracting authorities as named in Section VI herein.

    The initial requirement for One North East is for the supply of 12 DC/AC quick chargers for electric vehicles. It is anticipated that each framework supplier will each supply 4 units subject to availability in the project timescales.

    The agency reserves the right to award the supply of units as it sees fit to allow project completion to be achieved no later than 31.12.2010. It should be noted that appointment to the framework to provide these units is not a guarantee of contract award to supply one or more of the 12 units.

    Type of procedure

    Accelerated restricted

    Justification for the choice of accelerated procedure: The accelerated procurement process offered through the accelerated restricted procedure will benefit economies by providing speedier distribution of public finds to the potential suppliers resulting in a reduced lead time to the end product and achieving the aims of the project.

    Early execution of the funds will also benefit the impact of this project and allow the regional infrastructure for charging of electric vehicles, to be in place, boosting confidence and promoting awareness in EVs and the use of the related charging infrastructure.

    The output of the Contract will also support and grow this new industry in the UK's largest volume automotive manufacturing region. The vision supports the early market for EVs and will stimulate public and private sector investments to accelerate the uptake of EVs, and to seed the organic growth of infrastructure.

    The market's ability to respond and to meet the reduced timescales have been taken into consideration and due to the nature and diversity of this project, as well as assuming this procurement will act as a catalyst for supply in this sector, this is the best procedure to take.

    Limitations on the number of operators who will be invited to tender or to participate

    Objective criteria for choosing the limited number of candidates: The contracting authority shall make the selection of the economic operators to be invited to tender in accordance with regulations 23, 24, 25 and 26 and shall award the contract in accordance with regulation 30 of the Public Contract Regulations 2006 as amended. Bidders will be invited to tender where they have satisfied the agency's minimum standards. Where there is a sufficient number of bidders suitable to be selected to be invited to tender, no less than 5 bidders who satisfy the minimum standards. If more than 5 bidders meet the minimum standard, it is envisaged that no more than 5 bidders will be taken to ITT stage.

    Please note that the agency may clarify responses given as part of the pqq evaluation process.

    Minimum Standards:

    (1) A score of 60 % or more on the technical element (Regulation 25 and Section 10 of the on-line questionnaire) questionnaire and achieving a pass mark in the other areas of the pqq.

    (2) Mandatory exclusion (Regulation 23 and Section 2 of the on-line questionnaire) will be evaluated on a pass/fail basis.

    (3) Discretionary grounds for exclusion (Regulation 23 and Section 2 of the on-line questionnaire) will be evaluated on a pass/fail basis.

    (4) The financial standing (Regulation 24 and Section 3 of the on-line questionnaire) of the bidding organisation will be assessed on a pass/fail basis. The agency will undertake a financial appraisal / risk profile of each pqq received. Where the score resulting from the financial appraisal / risk profile produces a rating of less than 50 %, the agency will seek to obtain financial assurance from bidders through a parent company guarantee or performance bond. Where financial assurance cannot be provided, the contracting authority may fail a supplier.

    (5) Insurance (Section 4 of the on-line questionnaire) will be evaluated on a pass/fail basis. Minimum levels of cover required are:

    Employers Liability £5,000,000.

    Public Liability £10,000,000.

    Third Party Liability £2,000,000.

    Bidders are requested to evidence within their PQQ response the levels of insurance currently held. Where an appropriate level of insurance is not held, the agency may request that bidders short-listed to ITT purchases the relevant insurances (amount to be agreed) prior to contract award.

    (6) Quality assurance (Section 5 of the on-line questionnaire) will be evaluated on a pass/fail basis. To achieve a pass mark, bidders must comply with the relevant standard.

    (7) Health & safety (Section 6) will be evaluated on a pass/fail basis. To achieve a pass mark, bidders must comply with the relevant legislation as set out in the online questionnaire.

    (8) Equality & diversity (Section 7) will be evaluated on a pass/fail basis. To achieve a pass mark, bidders must comply with the relevant legislation as set out in the online questionnaire.

    (9) Environmental management (Section 8) will be evaluated on a pass/fail basis. To achieve a pass mark, bidders must have an appropriate accreditation or system in place.

    "The agency" means One North East whose registered address is Stella House, Goldcrest Way, Newburn Riverside, Newcastle upon Tyne, NE15 8NY, UNITED KINGDOM (or any successor organisation(s)).

    Bidders should be aware that although the central purchasing body for the purposes of this procurement is the agency, the agency may allow one or more of the contracting authorities (as defined herein and within the tender documents) to access the concluded framework, without creating any obligation on any of them to do so. In that event, the contractual relationship would be between the approved Contracting Authority accessing the contract and the contractor.

    In addition the agency may novate the management of this procurement process and/or the subsequent award of the framework to another contracting authority (as defined herein and within the tender documents).

    "Contracting authority" means the purchasing organisation that is seeking to award a contract and for the purposes of this PQQ includes:

    I The agency.

    II A contracting authority as set out in regulation 3 of the Public Contract Regulations 2006.

    XIII Transport for London operating both as a functional body of the Greater London Authority (GLA) under the direction of the Mayor of London and as a provider of transport services. The services, supplies or works may be provided to TfL and/or its subsidiaries and/or the GLA family and/or public bodies in the Greater London area (as defined by the local authorities goods and services Act 1970 including the Metropolitan Police Authority (MPA) and the London Fire and emergency planning authority (LFEPA)), the London Borough of Bromley and the public bodies represented by the Pro5 Group (see www.espo.org/index.asp?CMD=PRO for further information), who are central purchasing organisations as defined by EU Directive 2004/18/EC and/or nominated parties for the benefit of any of the foregoing parties.

    XIV Any other public or private partner in One North East's bid(s) for North East area electric vehicle (including infrastructure) related funding including but not limited to the 'Plugged in Places' funding scheme (PiP) and/or nominated parties for the benefit of any of the foregoing parties.

    XV any other successful PiP (or similarly funded) bidder(s) in the UK but such services, supplies or works will not exceed 30 000 000 GBP.

    Any such contracting authority (other than the agency) may participate in the framework with the consent of the Agency and subject to any conditions the agency may reasonably impose including conditions that such contracting authorities:

    1. Agree to participate in the framework on the same terms as those agreed between the framework's members and the agency.

    2. That adequate arrangements are in place to ensure that potential conflicts of interest do not arise in such a way as to prevent the agency having access to any member firm within a particular lot.

    The contracting authority does not bind itself to accept any tender and withholds the right to appoint outside any contract should it be considered to be in the best interest of the Contracting Authority.

    The contracting authority is not liable for any costs incurred by those expressing an interest or tendering for this opportunity.

    Compliance with all legislation is required, both in the contract award procedure and during the term of the contract.

    The contracting authority reserves the right to extend the contract for a period of not more than 12 months.

    The contracting authority reserves the right to procure repeat services of a similar nature the services in this contract notice without a further call for competition to Regulation 14 (1) (d) (ii) of the Public Contracts Regulations 2006.

    Precise information on deadline(s) for lodging appeals: The contracting authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into.

    If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5), as amended, provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 6 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
