    VI.1)THIS IS A RECURRENT PROCUREMENT:

    Tenders will be evaluated on a 60 % commercial/price and 40 % technical/quality basis. A decision will be made on the basis of the most economically advantageous tender based on price, compliance with the specification, quality, method of operation and ability to take up the Contract on the due date.

    Under Section 89 (7) of the Transport Act 1985 and Section 152 (2) of the Transport Act 2000, the Council in issuing an invitation to tender shall, in determining whether to accept a tender submitted in response to the invitation or which (if any) of several such tenders to accept, have regard in particular to a combination of economy, efficiency and effectiveness. The Council shall also, in the exercise and performance of its functions in relation to agreements providing for service subsidies, as laid down by Section 92 (1) of the Transport Act 1985 and Section 152 (4) of the Transport Act 2000, have regard to the interests of the public and of persons providing public passenger transport services in its area.

    Mindful of these duties, the Council, when evaluating the bids that have been submitted for the Contract(s) covered by this tendering exercise, will therefore make an assessment of the passenger and network benefits that accrue from each possible combination of bids. Such an assessment will take into account, for example, the offer of through journey opportunities, the provision of through ticketing arrangements, inter-available ticketing and/or area ticketing schemes, the compatibility with existing local bus services and other such network impacts in the area(s) served by the contract(s). In so doing, the Council reserves the right to set aside any Tenders or not to make an award.

    It is possible that the Council will not award certain Contracts if the value of the lowest acceptable tender is considered to be unaffordable or excessive in relation to the social need satisfied by the journeys involved.

    Precise information on deadline(s) for lodging appeals: The Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to receive further debriefing from the contracting authority before the contract is entered into. Applicants who are unsuccessful shall be informed by the Authority as soon as possible after the decision has been made as to the reasons why the Applicant was unsuccessful. Should additional information be required it should be requested of the addressee in section I.1. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales, and Northern Ireland). Any such action must be brought promptly (generally within three months). If a declaration of ineffectiveness is sought, any such action must be brought within 30 days where the Authority has communicated the award of the contract and a summary of reasons to tenderers, or otherwise within 6 months. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Authority to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
