  The contract will be for initial period of 3 year with an option to extend at Fyne Homes Ltd, Fyne Initiatives Ltd, Fyne Futures Ltd sole discretion for a further period of 2 years.

  In addition quotations based on 5 year long term agreement are also invited.

  Notes of Interest from Insurance Brokers / Intermediaries will not be considered as Marsh is appointed as Insurance Broker to the Fyne Homes Group.

  1. Insurance Carriers should be recoginesed Insurers Authorised to write the classes of business listed above in accordance with the relevant legislation.

  2. Potential Suppliers may be asked to produce a certificate issued by the appropriate Insurance Regulatory Authority

  Indicating the types of insurance the Insurers are Authorised to provide and must comply with the Department of Trade and industry Regulations.

• III.2)CONDITIONS FOR PARTICIPATION
• III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers:

  Information and formalities necessary for evaluating if requirements are met: Potential Suppliers may be asked to produce a certificate issued by the appopriate Insurance Regulatory Authority.

  Indicating the types of insurance the Insurers are Authorised to provide and must comply with the Department of Trade and industry Regulations.

• III.2.2)Economic and financial capacity:

  Information and formalities necessary for evaluating if requirements are met: (a) A copy of the most recent audited accounts for your organisation that cover the last 2 years of tradingor the period that is available if trading for less than 2 years.

  (b) A statement of the organisations turnover Profit & Loss and cash flow position for the most recent full year of trading (or part year if full year not applicable) and an end period balance sheet,where this information is not available in an audited form at (a).

  (c) Where (b) cannot be provided, a statement of the organisation cash flow forecast for the current year and a bank letter outlining the current cash and credit facility position.

  (d) If the organisation a subsidiary of a group, (a) to (c) are required for both the subsidiary and the ultimate parent. Where a consortium or association is proposed, the information is requested for each member organisation.

  (e) A separate statement of the organisations turnover that relates directly to the supply of this service for the past 2 years, or for the period the organisation has been trading (if less than 2 years).

  (f) Parent organisation/or other guarantees of performances and financial standing may be required if considered appropriate. Confirmation of the orgainiastions willingness to arrange for a guarantee or a performance bond.

  (g) Insurers must have a credit rating at least or above A- with A M Best BBB with Standard & Poor's with an unencumbered Policyholder's surplus of 50 000 000 USD.

  — evidence of adequate risk management facilities and ability to provide a high quality claims handling service,

  Accelerated restricted.

  Justification for the choice of accelerated procedure: Urgency. The Insurance Renewal date is 1.4.2010 and the holding insurer has broken the existing Long Term Agreement. Fyne Homes Group was not expecting this agreement to be broken.

• VI.4.2)Lodging of appeals:

  Precise information on deadline(s) for lodging appeals: The Contracting authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers.

  This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from teh notification of the award decision to request additional debriefing and than information has to be provided a minimum of 3 working days before the expiry of the standstill period.

  Such additional information should be requested from the contracting authority as detaile din section I.1 of this Notice.

  If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts (Scotland) Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the Sheriff Court or Court of Session.

  Any such action must be brought promptly (or in any event within 3 months).

  Where a contract has not been entered into the Court may award the setting aside of the award decision or order the authority to amend any document and may award damages.

  If the contract has been entered into the Court may only award damages.

  (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into).
