3. Financing:
3.1. State owned firm PLINACRO, Ltd. (Zagreb, Croatia) own resources.
3.2. Plinacro has obtained a loan from European Investment Bank - EIB (hereinafter referred to as the "Bank") towards the cost of the Project of expansion and modernisation of the Croatian gas transmission system.

CONTRACT SPECIFICATION

5. Contract description:
Construction of the Main Gas Pipeline Vodnjan-Umag, DN 300/50 - length 72, km and installation of 4 associated measuring-reduction stations (Rovinj, Poreč, Kovri and Umag).

6. Maximum period for completion of works:
210 calendars days from the Notice to Commence the works.
CONDITIONS OF PARTICIPATION

7. Eligibility and rule of origin:
Participation is open on equal terms to all firms/legal persons - participating either individually or in a grouping (Joint Venture) of Tenderers.

8. Grounds for exclusion:
Firms of a country may be excluded if, in accordance with a decision of the United Nations Security Council, taken under Chapter VII of the Charter of the United Nations, the Employer's country prohibits any imports of goods from that country or any payments to persons or entities from/in that country.

9. Number of tenders:
Tenderers including firms within the same legal group, other members of the same Joint Venture and sub-contractors may submit only one tender.
Tenders for parts of the tendered works will not be considered. Tenderers may not provide a tender for a variant/alternative solution in addition to their Tender for the works required in the Tender Documents.

10. Tender:
Tenderers must provide a Tender Security issued by a first class bank, amounting to 3% of the Tender Price, when submitting a Tender. This Security will be released to unsuccessful Tenderers once the tender procedure has been completed and to the successful Tenderer upon signature of the contract by both parties. The Security will be called upon if the Tenderer does not fulfil all obligations stated in its tender.

11. Clarification questions:
Tenderers which have questions regarding the Tender Documents should send them in writing to the above mentioned fax (No.## (385-1) 63 06 28) mentioning the Publication reference stated in the item 1 here above - at least 21 days before the deadline for submission of Tenders, specified in the item 14. The Contracting Authority - the Employer will reply in writing to all Tenderers' questions and send these answers at the latest 14 days before the deadline for submission of Tenders to all candidates that have procured the Tender Documents.
The Contracting Authority may modify some provisions of its Tender Documents at its own initiative, at the latest 14 days before the deadline for submission of Tenders.

12. How to obtain the Tender Documents:
The Tender Documents are available from the Contracting Authority - the Employer, at the above mentioned address, first floor, room 207 (Ms Matea Marković, tel: (385-1) 630 16 36, fax: - " - 628 from 9. to 11 a.m.)
The Tender Documents in Croatian and/or English language ) may be obtained either by bank payment of non-refundable fee of 1 500 HRK (or, euro 200) to the PLINACRO bank, by Raiffeisenbank Austria d.d, Zagreb, Petrinjska 59, swift RZBHHR2X, IBAN: HR 7624840081100780686 with the following reference: PN-I-398/08-GB (foreign Tenderers) or to the PLINACRO bank account No. 2340009-1100225794, by Privredna banka Zagreb, Croatia - with the following reference: PN-I-398/08-GB (domestic Tenderers).
At written candidates-firms request, accompanied by payment evidence, the Contracting Authority shall send Tender Documents by mail to these firms, but in no way will be responsible for possible delay in shipment or loss of these documents.

13. Tender submission conditions:
Tenderers must submit their offers in English, or in Croatian language using the standard Tender submission form included in the Tender Documents, format and instructions of which must be strictly observed.

14. Deadline for submission of Tenders:
November 3, 2008, until Midday (11:00 a.m.) local time.
Any Tender received after this deadline will not be considered.

15. Tender opening session:
The venue of the tender opening is: Plinacro, Ltd., Savska cesta 88 a, 10.000 Zagreb, Croatia, first floor, room No. 206 B. The session may be attended by designated and authorised representatives of Tenderers having submitted Tenders.

16. Tender validity:
Tenders must remain valid for a period of 90 days after the deadline for submission of Tenders.
SELECTION CRITERIA and AWARD of CONTRACT

17. Selection criteria:
The selection of the legally, economically, financially and technically acceptable Tender will be carried out in accordance with Tender Documents.

18. Award criteria:
The lowest price.

19. Performance Security and Contract award:
The successful Tenderer will be requested to provide a Performance Security of 10% of the contract value in EURO, or in HRK, when counter-signing the Contract.
The counter-signing and the procuring of Performance Security must be carried out within 14 after receipt by the successful Tenderer of the Letter of Acceptance sent by the Contracting Authority - Employer.
If the selected Tenderer fails to counter-sign the Contract and provide such a Security within this compulsory period, the Contract will be void and null and a new contract may be drawn up and sent to the Tenderer, which has submitted compliant Tender with the next lowest price.
