7. Contract description:
The aim of the programme is to support and strengthen national and regional capacities in the following 3 fields: conservation and preservation of heritage, promotion of heritage and cultural development, and promotion and professionalisation of artistic production. Through this invitation to tender, the contracting authority, with a total allocation of EUR 3 000 000 for a term of 4 years, plans to hire a project management unit to be responsible for implementation of the project's various elements.

Conditions for participation
Participation is open on equal terms:
— to all natural persons or legal entities (taking part either as individuals or as part of a grouping (consortium) of tenderers) established in an ACP country or EU Member State that contributes to the European Development Fund, and to international organisations authorised by the specific instruments applicable to the programme under which the contract is financed (see also point 28).
Natural persons or legal entities who are eligible (see point 10) or groupings of said parties (consortia) may apply.
A consortium can be a permanent, legally established grouping or an informal grouping created for a specific tender. All the members of a consortium (i.e. lead company and all other partners) are to be jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity take part (see point 10), the party concerned will be automatically disqualified. Should the ineligible party be a member of a consortium, their exclusion will result in the consortium being excluded.
12. Number of applications:
The natural persons or legal entities concerned can only submit 1 application regardless of the form their participation may take (as an individual legal entity, lead company or partner in a consortium of candidates). Should a natural person or legal entity submit more than 1 application, all applications in which said party has participated will be disqualified.
13. Prohibition on alliances between shortlisted candidates:
Tenders which include companies not mentioned on the application forms used to compile the shortlist will be excluded from this restricted procedure. Shortlisted candidates may not form alliances or subcontract to each other for the contract in question.
14. Grounds for exclusion:
Candidates must sign and return with their application the declaration supplied confirming that they are not in any of the exclusion situations referred to in section 2.3.3 of the Practical Guide to contract procedures for EC external actions.
Subcontracting is not permitted.

Depending on the applications received, between 4 and 8 candidates will be invited to submit detailed tenders for this contract.

Selection and award criteria
20. Selection criteria:
The selection criteria must be clear and non-discriminatory and must not go beyond the scope of the contract. Candidates should be aware of the documentary proof that will be requested for the corresponding selection criteria. See section 2.4.12 of the Practical Guide to contract procedures for EC external actions.
The following selection criteria will be applied to candidates. Where an application is submitted by a consortium, these criteria will apply to the consortium as a whole.
(1) Candidates' economic and financial capacity (based on section 3 of the application form):
(a) candidates' average annual turnover must exceed EUR 350 000;
(b) average cash and cash equivalents must be positive at the beginning and end of the financial year.
(2) Candidates' professional capacity (based on sections 4 and 5 of the application form):
(a) candidates must have the appropriate human resources and professional qualifications for this contract, for example in the fields of conservation and preservation of heritage, promotion of heritage, or promotion and professionalisation of artistic production;
(b) at least 2 technical staff members must be working presently in fields related to this contract.
(3) Candidates' technical capacity (based on sections 5 and 6 of the application form):
(a) candidates or consortia must have the necessary technical knowledge and experience to ensure the successful completion of the proposed contract;
(b) candidates or consortia must have obtained good results in the past 3 years in at least 1 project with a budget equal to or higher than the budget for this contract and in the same fields.
Economic operators may, where necessary and for a specific contract, make use of the capacities of other entities, irrespective of the legal nature of the connection between themselves and these entities. In such a case, they must provide the contracting authority with proof that they will have the resources needed to carry out the contract by, for example, producing a signed commitment from said bodies to make such resources available. These entities must respect the same eligibility rules as the economic operator, particularly with regard to nationality.
If more than 8 eligible candidates meet the above selection criteria, there will be a re-evaluation of their strengths and weaknesses to determine the 8 strongest applications. Only the following factors will be considered in this re-examination:
(1) relevant work carried out in PALOP and/or ACP countries;
(2) number of years' experience in fields relevant to this contract.

The envelope containing the application must be clearly marked with the contract title and the publication reference (see point 1). These must also be quoted in all subsequent correspondence with the contracting authority.
Applications sent by any other means will not be accepted.
25. Amendment or withdrawal of applications:
Candidates may give notice in writing of their intention to amend or withdraw their applications before the final date for receipt of applications. Applications may not be amended after the final date for their receipt.
Notifications of amendment or withdrawal must be drawn up and submitted in accordance with the procedures in point 25. The words 'Alteração' (amendment) or 'Retirada' (withdrawal), as applicable, must be written on the outer envelope (also on inner envelope, if applicable).
