Short description of the contract or purchase(s)
This service specification is for the provision of Residential Care Placements for Children and Young People who are looked after.

The overall requirement of this Contract is that Service Users will be placed in an establishment that is able to provide a high quality, stable, safe, supportive and enabling residential home base for each Service User. This Service may include the following but should not be limited to Care, Room and Board, Clothing, Routine Transport, Excursions, Recreational Activities. The Provider will also provide flexible, intensive support to Service Users who move from the residential establishments to independent accommodation, responding to individual need. The Provider will be a Registered Residential Care Provider and as such will be governed by the terms of that registration. The residential placements are required for a minimum of 9 Service Users aged from 15 years including young parents with their babies. The Provider will ensure that staff will be experienced and prepared to care for Service User who may have challenging behaviour. It will be a requirement of this Contract that each Service User must have their own bedroom. If the placement is a parent and baby placement, it may be required that the baby will share a room with its parent depending on individual needs.

It is anticipated that the Contract will start on 1.4.2017 with the requirement that the Provider will be set up and ready to accept referrals for the Service.

Lodging of appeals
Precise information on deadline(s) for lodging appeals: A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2012 may bring proceedings in the Sheriff Court or the Court of Session. The City of Edinburgh Council (the Council) will have a minimum voluntary standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers with the voluntary standstill period commencing on the next working day. If proceedings are started in the Sheriff Court or the Court of Session against the Council in respect of the decision to award the contract within the voluntary standstill period then the Council is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on the Council. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the OJEU or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
