IV.1.1)Type of procedure
- The contract has as its object services listed in Annex II B to the directive
The FAST Project team, part of the UK Ministry of Defence, intends to award a contract to SAAB AB, Electronic Defence Systems (the ‘Contractor’) for the procurement of 100 Typhoon BOL IR Modified Enhanced Air Scoops (MEAS) and x3 Maintenance Cables. In addition, the MOD will also have the option to procure additional MEAS and Maintenance Cables up to the same quantity as stated in the original requirement.
It is considered that this requirement can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of The Council (Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011), for technical reasons.
SAAB is the only economic operator capable of meeting the MOD's requirement for the MEAS, as only SAAB has been granted a Declaration of Design Performance [for this equipment] by Eurofighter (Eurofighter GmbH), the Design Authority.
