Section III: Legal, economic, financial and technical information
III.1) Legal form to be taken by the grouping of suppliers, contractors or service providers to whom a contract might be awarded:
Legal capacity will be assessed on the basis of the following document:
— proof of entry on the professional or trade register under the conditions laid down by legislation in the country in which the candidates reside.
III.2) Economic and financial standing:
Candidates must have sufficient economic and financial capacity to enable them to perform potential future contracts in compliance with the contractual provisions. Financial and economic capacity will be assessed on the basis of the information included in the following documents, to be supplied by tenderers:
— the presentation of balance sheets or extracts from balance sheets for at least the last 3 years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established,
— if the balance sheets or the statements show an average loss over the past 2 financial years for which accounts have been closed, then the candidate must furnish another document as proof of his financial and economic capacity, such as appropriate bank references or proof of professional risk insurance cover.
III.3) Technical competence:
Candidates must have sufficient technical and professional capacity to enable them to perform potential future contracts in compliance with the contractual provisions. The Court requires candidates to have a minimum technical and professional capacity which will be assessed on the basis of the following elements:
— a catalogue of the products the candidates propose shall encompass at least one half of the products of the field for which they apply.

Applicants shall be excluded from participating in a contract if:
(a) they are bankrupt, being wound up or have suspended business activities, their affairs are being administered by the court, they have entered into an arrangement with creditors or similar measures or are the subject of any proceedings of that nature, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they have been convicted of an offence concerning their professional conduct by a judgment which is not open to appeal;
(c) they have been guilty of grave professional misconduct;
(d) they have not fulfilled obligations relating to the payment of social security contributions or taxes;
(e) they are guilty of serious misrepresentation in supplying the information required by the authorising department;
(f) other: all cases listed in Articles 106 and 107 of the Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 — hereinafter referred to as 'the Financial Regulation' (OJ L 298 of 26.10.2012, p. 1).

Section VI: Complementary information
VI.1) Presentation and submission of applications:
Anyone interested may submit an application at any time during the list's period of validity, except for the last 3 months thereof. The contracting authority will regularly evaluate new applications received every 2 months.
Candidates may choose to submit applications:
a) either by post or by courier service to the address indicated below;
b) or delivered by hand to the reception desk. The reception desk is open from 8:00 to 17:00, Monday to Friday. It is closed on Saturdays, Sundays and European Court of Auditors' holidays.
