2. Application procedure:
The objective of this call for expressions of interest is to set up 3 lists of pre-selected candidates for a donation of scientific equipment (laboratory equipment and furniture). The scientific equipment to be donated has been used and fully depreciated by the JRC sites of Ispra (Italy), Geel (Belgium) and Petten (Netherlands). Candidates may express their interest for more than 1 site.
The equipment will be donated to scientific and/or educational organisations that are public entities or are controlled by public entities from the Member States or associated countries, as specified in the EU research and innovation framework programme Horizon 2020.
Expressions of interest should be submitted, following the rules set out in this notice, in one of the official languages of the European Union by regular mail to the address indicated at point 1 to the attention of: JRC/IPR/2014/B.4/0019/AMI, anticipated by e-mail to the following address: firstname.lastname@example.org
Interested candidates should apply in accordance with the provisions contained in this notice and the purposes stated therein. The expression of interest must state the JRC site for which the candidate is applying (Ispra and/or Geel and/or Petten) and the reference number JRC/IPR/2014/B.4/0019/AMI. The application to this call for expressions of interest must also include the information and documents requested.
Inclusion on the list entails no obligation on the part of the contracting authority concerning the conclusion of the donation contracts.
3. Information and documents to be provided:
Candidates should provide their full contact details and indicate which list, indicated at point 7 of the present notice, concerns them in their expression of interest.
The supporting evidence to be provided for the evaluation of the selection criteria is indicated at point 11.
Candidates shall provide a declaration on their honour to be found at https://web.jrc.ec.europa.eu/callsfortender/index.cfm?action=app.homepage under procurement code: JRC/IPR/2014/B.4/0019/AMI stating that they are not in one of the situations of exclusion listed at point 10. It is to be duly signed and dated by an authorised representative. The contracting authority may request, in case of doubt, that the candidate provide supporting evidence of non-exclusion.
Questions relating to this call for expressions of interest must be sent solely by e-mail to the address stated in point 1. They may be sent any time during the validity of the e-notice, except for the last 3 months prior to the end of validity of the lists. 4. General description of the procedure:
4.1 Definition of the call for expressions of interest procedure:
Interested parties are invited to submit an expression of interest in accordance with the rules set out in this notice and in the administrative annex (declaration on honour) provided on the JRC website https://web.jrc.ec.europa.eu/callsfortender/index.cfm?action=app.homepage under the reference JRC/IPR/2014/B.4/0019/AMI.
The contracting authority will draw up 3 lists of pre-selected candidates who meet the criteria set out at point 11, 1 for each of the concerned JRC sites of Ispra, Geel and Petten. These lists correspond to what is described at point 7.
Candidates may express their interest for more than 1 site and are requested to specify in their applications the JRC site(s) for which they are applying. The contracting authority should evaluate the applications it receives at regular intervals (every quarter of a year). Evaluation will be carried out by a nominated committee.
The contracting authority shall make a list of candidates for each site (Ispra, Geel and Petten) where only candidates who meet the selection criteria set out at point 11 of this notice will be included. These lists will be used as a base for further selection of the candidate for donation.
4.2. Method of invitation and award:
Step 1 — Invitation:
Each time contracts of donation are to be concluded for one of the JRC sites, as described in point 7, the contracting authority will invite all candidates from the list related to the involved JRC site to express their interest in 1 or more lots of scientific equipment to be donated. An invitation letter will be sent to the candidates. It will include an overview detailing the nature and volume of goods to be collected, specifying the kind of scientific equipment for the donation and describing the award criteria. The candidates will be requested to confirm or decline their interest in writing.
If the candidate does express his interest to participate in a donation of scientific equipment from the invitation letter, he will be put in the list of candidates set for step 2 — award.
Step 2 — Award:
The following criteria will be considered for the award:
1. the GDP per capita related to the candidate's country of residence;
2. present or past collaboration agreement between the JRC and the candidate;
3. award criteria defined by the nominated committee of the final award.
Ad 1: Candidates coming from countries with lower GDP per capita will have precedence over candidates coming from countries with higher GDP per capita. The GDP per capita considered for the award of the contract will be the last one available, as published on the Eurostat web page, at the date of the awarding procedure (http://epp.eurostat.ec.europa.eu/portal/page/portal/eurostat/home/). In case the candidate's residence country is not included in the Eurostat database, the GDP per capita from the International Monetary Fund website will be considered (http://www.imf.org/external/pubs/ft/weo/2014/02/weodata/weoselgr.aspx).
Ad 2: As cited in the second criterion, a present or past collaboration agreement with the JRC will give the candidate priority to be chosen for a donation if more than 1 candidate is interested in a donation from the same country and has the same GDP per capita.
Ad 3: In case there is more than 1 candidate with the same GDP per capita that also fulfils the second criteria, the final award criteria will be defined by a nominated committee. The contracting authority will nominate committees, per each JRC site, which will be in charge of evaluating the candidates and defining the award criteria. They will ensure that the principles of objectivity, transparency, proportionality and non-discrimination are fulfilled. Details of the award procedure, as well as the technical specifications for the scientific equipment's donation, will be defined in the invitation letter.
The nominated committee will establish a final list of (awarded) candidates based on the above criteria. To the candidate in first place, a contract for equipment to be donated will be sent. Should the candidate at this stage partly or fully decline the request, the contracting authority shall be entitled to send a request to the next candidate on the list of (awarded) candidates.
5. Protection of personal data:
If processing your expression of interest involves the recording and processing of personal data (such as your name, address and CV), such data will be processed pursuant to Regulation (EC) No 45/2001 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. Unless indicated otherwise, your reply to this notice and any personal data requested are required for the purposes indicated above in point 4 and will be processed solely for those purposes by the contracting authority indicated in point 1, which is also acting as data controller. Your personal data may be registered in the early warning system (EWS) only or both in the EWS and central exclusion database (CED) by the Accounting Officer of the Commission, should you be in one of the situations mentioned in:
— the Commission Decision 2008/969 of 16.12.2008 on the early warning system (for more information see the privacy statement on http://ec.europa.eu/budget/contracts_grants/info_contracts/legal_entities/legal_entities_en.cfm), or

6. Use of the list resulting from this notice:
The list resulting from this notice will be used exclusively for contracts of the following types: contract for a donation of downgraded scientific equipment.
7. Full description of the fields covered by the call for expressions of interest:
The CEI (call for expressions of interest) lists will be applicable to the Joint Research Centre of the European Commission as follows:
— list 1: JRC Ispra site (Italy),
— list 2: JRC Geel site (Belgium),
— list 3: JRC Petten site (Netherlands).
The equipment that could be donated is the following: laboratory, optical and precision equipment, laboratory pipettes and accessories, laboratory furniture, laboratory benching and laboratory pumps and accessories.
The list of equipment as above is not exhaustive. The contracting authority may add to the list new categories of scientific equipment to be donated.
8. Place and conditions of delivery:
The equipment will be given away free of charge under the following conditions:
a) The place of collection of scientific equipment shall be JRC — Ispra, Italy and/or JRC — Geel, Belgium and/or JRC — Petten, Netherlands, depending on the place where the equipment is located.
b) The candidate will collect the goods using their own resources and staff and under his own responsibility.
c) All customs costs and any VAT amount due on these equipment items are borne by the candidate.
d) Equipment is given away in its present condition, unpacked, without any operational or other kind of guarantee. No support is given once the donation is concluded.
e) The candidates must keep the donated equipment for use in their own activities as declared (see point 11) for a minimum period of 3 years.
f) The contractors undertake to strictly comply with the applicable regulations on environmental protection, including with dismantling any goods should this be necessary, and to cover any cost entailed therein.
g) Kindly note that is the candidates' responsibility to immediately notify the contracting authority of any change in their administrative, technical or financial data which would result in a change to the original application during the validity of the lists (see point 9).
9. Expiry date of the list resulting from this call for expressions of interest:
The lists resulting from this notice are valid for 3 years from dispatch of this notice to the Publication Office. Interested parties may submit an application at any time prior to the last 3 months of validity of the lists.
10. Exclusion criteria:
Candidates shall be excluded from participation if:
(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they or persons having powers of representation, decision-making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of 'res judicata';
(c) they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify including by decisions of the European Investment Bank and international organisations;
(d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
(e) they or persons having powers of representation, decision-making or control over them have been the subject of a judgment which has the force of 'res judicata' for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such an illegal activity is detrimental to the Union's financial interests;
(f) they are subject to an administrative penalty for being guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in a procurement procedure or failing to supply information, or being declared to be in serious breach of their obligations under a contract covered by the budget;
(g) they have a conflict of interest in connection with the contract; a conflict of interest could arise in particular as a result of economic interests, political or national affinities, family or emotional ties or any other relevant connection or shared interest.
11. Selection criteria:
Criteria relating to technical and professional capacity:
1) The equipment will only be donated to scientific and/or educational organisations that are public entities or are controlled by public entities.
Relative to point 1):
a) The candidate shall provide a copy of the resolution, law, decree, decision or any other official document establishing the organisation as a public body or as an organisation controlled by a public body.
b) The candidate shall provide evidence stating that the organisation carries out scientific research and/or education as one of its main objectives (e.g. the statutes of organisation).
2) The candidates shall be registered in EU Member States and/or associated countries as stated in the EU research and innovation framework programme Horizon 2020.
3) Candidates shall provide a declaration on honour that the scientific equipment donated by the JRC will be used exclusively for scientific research and/or educational purposes and for a minimum period of 3 years.
12. Ex-post transparency:
Details on the contractors who have concluded a donation contract following the procedure set out at point 4 shall be published on the website of the contracting authority no later than 30 June of the year following the contract award.
These details include name, locality (address for legal persons and region of origin for natural persons), amount and subject of the contract. For natural persons, the information shall be removed 2 years after the year of contract award.
