The Air Defence & Air Traffic Services Delivery Team, part of the UK Ministry of Defence intends to award a contract to CAE (UK) plc for the procurement of a Hybrid VISSIM-TTF simulator system. It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 31 (1)(b) of Directive 2004/18/EC (Regulation 14 (1)(a)(iii) of the UK Public Contracts Regulations 2006). This is for reasons connected to the protection of exclusive design rights in the VISSIM-TTF equipment belonging to CAE (UK) plc as such the hybrid equipment cannot be designed without access to that protected information.
