Thames Water has a desalination facility, located on the Beckton Sewage Treatment Works in London. There are currently 5 Catepillar 3516B-HD diesel generators on-site, running on biodiesel fuel, to power the desalination plant. The maximum power from the 5 engines is 1.6 MW each (8 MW total). Thames Water has a legal obligation with London Borough of Newham and other stakeholders to provide renewable energy to power the desalination facility (referred to as ‘Section 106 obligations’).
Thames Water is now looking to improve the overall cost effectiveness and operation of its biodiesel engine facility:
Lot 1.
Operation, monitor and maintenance of the biodiesel engines, plant and equipment located at Beckton Sewage Treatment Works. Responsible for the accreditation of ROCs (as applicable). The electricity generated will be used to power the Beckton desalination facility. It is envisaged this will be an 'input-based' contract.
Lot 2.
Supply of suitable ‘green’ biofuels that can be used in the biodiesel engines at Beckton Sewage Treatment Works, to power the Beckton desalination facility.
Lot 3.
Ability to manage the combined scope of Lot 1 and Lot 2 good and services as a 'managed service' and provide electricity to power the Beckton desalination facility. It is envisaged this will be an 'output-based' contract.

Responses to the OJEU Notice should consist of a covering letter up to a maximum of 2 pages (4 sides) of A4 paper, a completed PQQ (one relevant to the relevant Lot of interest) and the supporting documents as requested in the PQQ.
The response also expects suppliers to apply for, complete and return a Pre-Qualification Questionnaire (PQQ) document by 12:00 noon BST, 11.7.2012.

Respondents are requested to submit bids that comply to the following contract/framework agreement duration:
Lot 1: 5 years.
Lot 2: 3 + 2 years.
Lots 3: 5 years.
Respondents are invited to submit variant bids for longer contract durations, up to the following:
Lot 1: Up to 10 years.
Lot 2: N/A.
Lot 3: Up to 15 years.
Contracts will be governed by English law.
The procurement process is expected to run in two phases. This will consist of:
(i) a response to this notice, request for, completion and submission of the PQQ document, evaluation by TWUL and short listing of suppliers (against evaluation criteria provided), which will constitute the pre-qualification procedure; and
(ii) a response to the Invitation to Negotiate in which short listed bidders will submit their proposed solutions and pricing, as well as describing detailed pricing, performance and investment management mechanisms. The ITN process will involve clarification and dialogue.
Thames Water reserves the right to add more stages if required.
We intend to issue the ITN to up to 10 respondents for each lot.
Weighted selection criteria will be used to evaluate the responses to the PQQ document and further information is provided in the PQQ document.
Economic operators to whom Regulation applies 26(5) of the Utilities Contracts Regulations are ineligible for selection.
Applicants are required to certify that none of the circumstances specified in Regulations 26(1) and 26(5) of the Utilities Contracts Regulations applies to the applicant.
Applicants are required to provide details of any court judgments and prosecutions within the last 3 years.
General.
Thames Water operates an ongoing risk management approach with regard to the economic and financial capacity of its suppliers. Information will be obtained either from the supplier or an externally recognized provider. Information will be gathered upon commencement of the process and over the duration of the contract period.
Respondents should note that this process might require references to be provided and verified, attendances at meetings, talks and presentations at no cost to Thames Water.
Thames Water Utilities Limited reserves the right to award no contract(s) as a result of this award procedure. Except for the framework agreement(s), if any, concluded with successful tenderer(s), nothing in the procurement process shall create a contract, whether express or implied, between Thames Water Utilities Limited and any respondent.
Any agreement resulting from this contract notice may be modified to include further similar requirements at any site under the management of Thames Water Utilities Limited or its associated companies.
This contract notice does not preclude Thames Water Utilities Limited or its associated companies from issuing other contract notices for specific requirements from time to time.
Thames Water Utilities Limited (including its employees and advisors) does not make any representations, warranties or other commitments, whether express or implied, in relation to the accuracy, adequacy or completeness of the information provided to applicants in this Contract Notice or otherwise in connection with this procurement, except as may be specifically agreed in any contract concluded at the end of this tender process.

That notification will provide full information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into the Utilities Contracts Regulations (SI 2006 No 6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
