Provision of recycling collection to up to 65 000 households for Falkirk Council.
The contract is for an initial period of 5 years with an option to extend annually for a further two years. The value for the contract which covers the initial term plus the optional extensions is expected to range from 3500 000 to 4 900 000 GBP.

The contract is for an initial period of 61 months with the option to extend annually for a further period of 2 years. The contract value, including optional extension period is estimated to be 200 000 to 3 500 000 GBP.

Range: between 200 000 and 3 500 000 GBP.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required:
A Form of Bond equivalent to 10 % of the value of the contract for one year for each authority will be required. The Form of Bond will be required to be supplied within 14 days of official contract award.

For all three Lots the Economic Operator will be paid for the total number of households serviced.

Where more than one Economic Operator will be involved in providing the Service as a grouping then the Councils will seek Assignation Agreements assigning the individual elements of the Contract to the Councils in the event of default by one or more of the Economic Operators in the grouping under the same terms and conditions specified in the Contract.

Precise information on deadline(s) for lodging appeals: Falkirk Council will incorporate a minimum of 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the address in point I.1) of the contract notice.
If an appeal regarding the award of contract has not been successfully resolved The Public Contracts (Scotland) Regulations 2006 (SSI 2006 No 1) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
