II.1.4) Short description of the contract or purchase(s):

To supply and deliver a frozen meals service, consisting of a main course and dessert, to vulnerable adults living in their own homes throughout Derbyshire. The provider will be expected to supply a frozen meals service which delivers a variety of culturally and dietary appropriate foods. In addition, they will be expected to supply information to users and Derbyshire Adult Social Services staff on the nutritional content of the meal in line with present labelling regulations so people can make an informed decision about what they eat. Assessments will be undertaken by designated Adult Social Services staff and this will determine how many frozen meals are to be delivered to the individual and whether any associated frozen storage or reheating equipment are required. The provider will be expected to have appropriate vehicles with the capability of transporting frozen meals. Legislation to be taken into account when providing the service includes the Food Safety Act 1990, The Food Hygiene (England) Regulation 2006 and The Quick-frozen Foodstuffs (England) Regulations 2007. The Council welcomes consortia bids.

VI.3.2) Lodging of appeals:

Precise information on deadline(s) for lodging appeals: Derbyshire County Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum 3 working days before the expiry of the standstill period. Such additional information should be required from the County Procurement Officer.

If an appeal regarding the award of the contract has not been successfully resolved the Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at a risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the Authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
